What kinds of property can an SMSF buy?
Every SMSF property investment must meet the sole purpose test: it is made to provide retirement benefits for members. Within that, the common categories are:
1. Residential investment property
Allowed, but members, their relatives and related parties cannot live in it or rent it. It must be let at market rent to an unrelated tenant.
2. Commercial property
This is the most common category. One rule is especially distinctive: “business real property”, meaning property used wholly and exclusively in a business, such as offices, shops and warehouses, can be leased by the SMSF to a member’s own business, provided it is at market rent and the conditions are met.
This is a structure many business owners consider. But what counts as business real property is tightly defined, and mixed-use or partly residential property may not qualify.
3. Vacant land
Allowed, but if you plan to build on it, using borrowed money to build or improve is heavily restricted. Think this through before you buy, not after.
What is generally ruled out?
- Property that you or relatives live in, holiday homes included. Members and related parties cannot use it.
- Buying residential property from a related party, which is generally not permitted.
- Bundling several properties into one borrowing. A loan can relate to a single acquirable asset only.
- Major improvements funded by the loan after purchase.
If you borrow, check a few more things
SMSF borrowing needs a particular structure (see how SMSF property lending works), so on top of that confirm:
- Does the trust deed allow borrowing?
- Does the investment strategy cover this property type and its risks?
- Does the fund have enough liquidity to pay costs if the property is vacant, needs repairs or rates rise?
- Is it a single acquirable asset, such as one parcel of land or one dwelling, rather than several bundled?
- Lender appetite for the property type varies by lender.
